Overview
The Department of Health is regulating cooling towers under the Public Health Act. Building owners are responsible for obtaining a licence to operate cooling tower systems associated with their buildings, which include an evaporative condenser and fluid cooler.
The Department of Justice and Public Safety is responsible for ensuring compliance with the Act and Regulation.
Proposed amendments to the Water Circulation Systems Regulation are now posted for public review and input. The new amendments include reference to the New Brunswick Technical Guidelines for Water Circulation Systems. A draft copy of the Guidelines can be found here. Eligibility
A licence may be issued to a building owner who has completed an application for a licence and paid the required fee.
Description
Following recent outbreaks of Legionnaires’ disease in the province, the Government of New Brunswick has committed to implementing a regulatory framework that will be introduced in 2 phases.
• Phase 1: includes mandatory licensing of Cooling Systems (cooling towers) by August 1st, 2022
• Phase 2: includes legislated requirements such as water management plans and Legionella testing and is anticipated to be implemented by June 1st, 2023.
Violations of the Act or Regulation may lead to fines and/or licence suspension or revocation.
