Adjudicators under the Liquor Control Act

Notice of Vacancy

Overview:
The Department of Justice and Public Safety is seeking expressions of interest from members of the Law Society of New Brunswick who are qualified and interested in being considered for appointment as adjudicators to conduct hearings and make determinations under the Liquor Control Act (the Act). Hearings are held on an as needed basis, at the request of the Minister or as a result of an allegation of non-compliance with the legislation or conditions. There are normally four or five hearings a year.

Current position(s) to be filled:
Expressions of interest are invited from qualified candidates to fill three (3) adjudicator positions, with special consideration given to candidates with a background and/or experience in administrative law and adjudication.

Applications received may also be used to fill future vacancies.

Qualifications / Commitment:
Applicants must:

  • Be a member in good standing of the Law Society of New Brunswick for a minimum of 7 years;
  • Provide their résumé demonstrating significant experience in administrative law, preferably in conducting hearings;
  • Possess the ability to demonstrate adherence to any eligibility requirements as set out in the legislation, including security clearance; and
  • State their language capability, as some positions require written and spoken competence in French and English; others will require written and spoken competence in English only.

Persons prohibited from being appointed include:

  • those involved in issuing or renewing licences or permits;
  • those involved in inspections under the Act;
  • those involved in the sale, distribution or manufacturing of liquor;
  • those with an interest in
    • an establishment licensed under the Act;
    • any contract in respect of a licensed establishment;
    • purchases or sales made by the NB Liquor Corporation; or
    • those with a direct or indirect interest in an undertaking that puts the person’s interest in conflict with the interests of the Adjudicator or in carrying out the duties of the Adjudicator under the Act.

Candidates expressing interest should demonstrate relevant knowledge, skill and experience when submitting their application.

Essential and Asset Qualifications:
Adjudicators must reflect the gender and linguistic representation, as well as the cultural and geographic diversity of the province.

Conditions / Compensation:
Adjudicators are entitled to per diem at a rate of $250 per half-day hearing. In addition, travel and other expenses are reimbursed in accordance with the New Brunswick Government Travel Directive AD-2801

Expressions of interest (via the application form or a resume and cover letter) may be submitted by e-mail or regular mail. Submissions should include detail to demonstrate qualifications, education, volunteerism, board/committee experience, employment experience, linguistic proficiency in English and/or French, along with contact information (telephone number, civic address and e-mail address).
