Overview
The Financial and Consumer Services Commission administers the New Brunswick Pre-Arranged Funeral Services Act, which regulates contracts for the prepayment of funeral services and requires the funeral provider (funeral home) and a manager (licensed funeral director) to hold a valid licence to offer pre-arranged funeral contracts.
The funeral provider must employ or contract a manager to act on its behalf for each location that provides funerals in New Brunswick. The licensed manager will represent the licensed funeral provider in all matters relating to its licensed activities under the Pre-Arranged Funeral Services Act.

Description
The Pre-Arranged Funeral Services Act regulates contracts for the prepayment of funeral services. The Pre-Arranged Funeral Services Act specifies that funds held under such a contract be held in a trust account that is monitored by the Financial and Consumer Services Commission’s Consumer Affairs Division.
The Pre-Arranged Funeral Services Act provides cancellation rights and maximum penalties that can be charged for the cancellation of a pre-arranged funeral service contract. The Pre-Arranged Funeral Services Act also contains provisions for the Compensation Fund, which exists to reimburse consumers in case of a monetary loss. Penalties are provided under this legislation for non-compliance.
