Every person who knowingly obtains or assists another person to obtain assistance to which he/she is not entitled under the Family Income Security Act or the Regulations, commits an offense. It is the Department's responsibility to determine if the case should be considered for legal action.
Criteria
Legal action is to be considered when:
- documented evidence is available to verify eligibility during a specific period which resulted in an overpayment for the amount received,
- evidence is available that they did not notify the Department of the change in circumstances which resulted in overpayment
- evidence is available confirming they were aware of obligation to report change(s) in circumstances,
- overpayment is not due to administrative error by the Department, and
- amount of overpayment is equal to at least one month of assistance benefits.
