Does this only apply to people in the Graduated Driver’s Licence program?

No, this new requirement applies to all drivers under the age of 21. You must have a BAC of zero whether you are enrolled in the graduated driver’s licence program or not.

What happens if I violate this condition?

If you are found to have a BAC over zero you will be required to pay a $172.50 fine and your drivers licence will be suspended for 1 month. If you are enrolled in the graduated driver’s licence program, you will be required to pay a $172.50 fine, your driver’s licence will be suspended for 1 year, complete an alcohol rehabilitation course and restart the graduated driver’s licence program with no credit.
 

Does this requirement only apply to New Brunswick residents?

No, it applies to everyone operating a motor vehicle on New Brunswick highways.
 

If I am under 21, will my driver's licence state that I must maintain a BAC of zero?

As of June 1st 2009, new restrictions reflecting the 0.00% BAC requirement will be present on driver’s licences issued to both drivers who are enrolled in the Graduated Driver’s Licence program and those who are not.

Drivers enrolled in the Graduated Licence Program: The licence will have a G on the front and a restriction on the back explaining that the holder must maintain a 0.00% BAC while operating a motor vehicle until he/she reaches the age of 21.

Drivers not enrolled in the Graduated Licence Program: The licence will have an R on the front and a restriction on the back explaining that the holder must maintain a 0.00% BAC while operating a motor vehicle until he/she reaches the age of 21.

The Provincial Government has recently approved amendments to the Motor Vehicle Act regarding a new requirement for drivers. As of June 1st, 2009 all drivers under the age of 21 will be restricted to a blood alcohol concentration (BAC) of zero.
