1. What does graduated driver’s licence mean?

For new drivers it means that you’ll hold a learner’s licence until two levels of driving have been successfully completed, each level with its privileges and conditions.

2. How does the program work?

The graduated driver’s licence program is for a minimum of 24 months, divided between Level 1 and Level 2.

Level One: The new driver is required to spend 12 months in Level one unless he/she successfully passes a licensed driver training course in which case this period may be reduced to 8 months. (As of Oct. 1, 2009)

Level Two: Upon successful completion of a road test, the new driver can earn more privileges in Level two. Level two lasts a minimum of 12 months.

3. Under what circumstances would you have to restart the program?

If you:

1. are convicted of a driving offence under the Criminal Code of Canada;
2. have loss of all points on your driver’s licence,
3. are found to have a blood alcohol level (BAC) of more than zero, while in the graduated driver’s licence program, your driving privileges will be suspended and upon reinstatement, you will be required to restart the program with no credit given. This also includes any credit given for previously completed driver training course.

4. What are the new restrictions?

The new program restrictions are:

Extending Level one of the program from 4 to 8 months with completion of a licensed driver training course. This comes into effect as of Oct. 1, 2009.

As of June 1, 2009:

The accompanying licensed driver must have a Class 5 or better licence and a minimum of 3 years driving experience.

Driving Hours:

• Level 1 - Prohibited from driving between midnight and 5:00 a.m.
• Level 2 –If under 21, prohibited from driving between midnight and 5:00 a.m. unless accompanied by a driver with a Class 5 or better licence and at least 3 years driving experience. Automatic exemption granted for work and education; written application to the Registrar of Motor Vehicles required for other purposeful activities.

Limit of 3 passengers in a vehicle operated by a Level two driver, with no more than 1 passenger in the front seat.

5. If I am already enrolled in the graduated driver’s licence program will the new requirements affect me?

Yes, as of June 1, 2009, you will need to satisfy all the new requirements.. The exception is the requirement for eight months in Level one, which will be in effect as of Oct. 1, 2009.

6. Why can’t I drive after midnight?

Staying off the road when risks are higher is a good way to avoid collisions. The intent of the graduated driver’s licence program is to provide the opportunity for newly licensed driver’s to gain experience and proficiency under low risk conditions.

7. Can I get an exemption allowing me to drive at night?

During Level 2, automatic exemptions will be granted for work and education purposes. Written application to the Registrar of Motor Vehicles is required for all other purposeful activities.

8. What do I need to know about alcohol and the graduated driver’s licence program?

Drivers in the graduated driver’s licence program must not consume any alcohol before getting behind the wheel of a vehicle. All drivers under the age of 21 are restricted to a BAC of zero regardless of whether they are enrolled in the graduated driver’s licence program or not.

9. Is there an age limit for the graduated driver’s licence program?

No. If you have never had a driver’s licence before you are considered a new driver and must take part in the graduated driver’s licence program.

10. What will happen if I violate a graduated driver’s licence program condition or restriction?
