Starting on January 1, 2013, the New Brunswick Small Claims Court will commence accepting claims. Matters will be heard in the Small Claims Court for actions for debt, damages and/or the return of possession of personal property for an amount up to $12,500. Claims will be heard by an adjudicator (an experienced lawyer) and the process will be somewhat less formal than regular court processes.
The Small Claims Court procedure is governed by the Small Claims Act and the General Regulation under the Act. There are a specific set of forms that must be used in the Small Claims Court.
Prior to January 1, 2013:
If you started a small claims action in the Court of Queen’s Bench under Rule 80, you will complete the action in the Court of Queen’s Bench under the Rule 80 process.
