Policy Statement


It is the policy of the Government of New Brunswick to provide leave with pay for all statutory holidays for:

  • regular full time, part time and seasonal employees and
  • casual/temporary employees i.e., individuals with a minimum of 6 months continuous service on this basis.

It is the policy to provide leave with pay for public holidays only for:

  • individuals working on a casual/temporary basis with less than six months of continuous service and
  • individuals working part time for one third or less of the normal hours of work.

Note: Payment for holidays is subject to conditions, "Paid statutory holiday entitlement" and "Paid public holiday entitlement".

Note: Employees should receive the following days off surrounding Christmas without loss of pay:

  • when Christmas Day is a Monday, the 25th and 26th days of December, or
  • when Christmas Day is a Tuesday, the 24th, 25th and 26th days of December, or
  • when Christmas Day is a Wednesday or Thursday, the afternoon of the 24th as well as the 25th and 26th Days of December, or
  • when Christmas Day is a Friday, a Saturday or a Sunday, the 24th to 27th days of December inclusive.

Statutory/Public Holidays Policy applies to:

  • Management and Non-Union employees of Parts I, II and III of the Public Service.

Statutory Holidays Policy does not apply to:

  • Management and Non-Union employees who are
  • on leave of absence without pay
  • absent without leave
  • under suspension
  • unionized employees. Refer to the appropriate collective agreement. Reference should also be made to the Labour Relations Services Strike Manual.
  • those on personal service contract. Refer to the terms of the contract.

Public Holidays Policy applies to:

  • individuals working on a casual or temporary basis and summer students with less than six months of continuous service, or
  • individuals working for one-third or less of the normal hours of work.
 

Paid Statutory Holiday Entitlement

The following is the pay entitlement provision for Statutory Holidays.
 

Type of Employee Entitled to Paid Statutory Holidays
Regular full-time employees provided they were entitled to pay on both the working day immediately preceding and following the holiday
Regular part-time employees who work more than one third the normal hours of work

Seasonal part-time employees
on a pro-rated basis, provided they were entitled to pay on both their scheduled days of work immediately preceding and following the holiday
Casual/Temporary employees
(i.e., with a minimum six months continuous service on casual/temporary basis)
as for employees, above, for those working full time hours or part-time hours, respectively.
 

Work Scheduling on Holiday or Day of Rest

  • When a holiday other than Christmas coincides with an employee’s day of rest, the holiday shall be moved to the employee’s first working day following his day of rest.
  • Where a holiday occurs when an employee is on sick or vacation leave, the holiday is considered granted and no deduction is made from the employee’s sick or vacation leave credits.
 

Paid Public Holiday Entitlement

The following are the leave entitlement provisions for Public Holidays for individuals working on a casual or temporary basis with less than six months continuous service or for those working part time for one third or less of normal hours.
 

Type of Employment Entitled to Paid Public Holiday
Individuals working on a casual/temporary basis, for more than one third the normal hours of work, with less than 6 months continuous service. Provided they qualify (See ‘To qualify for public holiday pay’ below).
Individuals working part-time on a regular basis for one-third or less than one third the normal hours of work. Provided they qualify (See ‘To qualify for public holiday pay’, below), entitled on a pro-rated basis.

To qualify for pay for a Public Holiday, individuals must meet all of the following:
 

1 have been employed for at least 90 calendar days in the 12 calendar months before the public holiday;
2 have worked their scheduled day of work before and after the public holiday, unless there is good reason for not doing so;
3 report for and work their shift, unless there is good reason for not doing so if he/she agreed to work on the public holiday;
4 not be employed under a continuous arrangement whereby the individuals can decide when to work or not to work.
