Landlords can restrict smoking and growing cannabis, but not overall cannabis use


Overview

Landlords can restrict smoking and growing cannabis and inside their rental units but are not allowed to restrict the consumption of cannabis in other ways. If a landlord has units where smoking is allowed, they cannot restrict the smoking of cannabis.

 


Cannabis use

It is legal for anyone aged 19 and older to purchase, possess, consume, and cultivate cannabis in New Brunswick.

Consumption of cannabis in any form is prohibited anywhere but in a private dwelling or on land next to a private dwelling (for example, in your home or in your backyard). If consuming cannabis in another residence, you must have permission from the homeowner.


Medical cannabis

Medical cannabis consumers are still restricted by the leases they sign. Cannabis comes in many forms, and while landlords can restrict growing cannabis and smoking inside their units, they are not allowed to restrict the consumption of cannabis in other ways.


Cannabis and your lease

Landlords should outline their expectations in their leases and ensure that tenants are informed about their rights and responsibilities. Unless a lease says specifically that smoking or growing cannabis is prohibited, then it will be allowed in the rental unit.

Landlords who have already established a “no smoking” policy in their rental units, will not have to re-write this in their leases, as “no smoking” is inclusive.
