Criminal Code Review Board

Members

Overview:

Section 672.38 of the Criminal Code of Canada requires that a Review Board be established in each province. The Board makes, or reviews dispositions made by the criminal courts concerning accused found not criminally responsible by reason of mental disorder or unfit to stand trial.

The Board must consist of not fewer than five members. Members must include a Chairperson, at least one psychiatrist, and one other member who is a psychiatrist, a psychologist or a medical doctor with a background in the field of mental health and may include members from the community at large with the appropriate qualifications.

Current position(s) to be filled:

The provincial government is now accepting expressions of interest from qualified candidates as members of the Criminal Code Review Board for a five-year term.

Expressions of interest are invited to fill these positions but may also be used to fill future vacancies.

Qualifications/Commitment:

Qualified candidates will include those:

  • with training and experience in the field of mental health, medicine, psychology, social work or criminology; or
  • qualified for appointment as a judge of the Federal Court or of a superior, district or county court of the province, or has retired from such judicial office. These individuals who are appointed as a member may be designated as an alternate chairperson.

Written and spoken competence in English and French is preferred for all members.

The following are desirable characteristics of membership:

  • understanding of the applicable legislation and the Board’s mandate (Criminal Code);
  • criminal law and procedure;
  • forensic law, criminology and risk assessment;
  • mental health law, practice and service delivery systems; and
  • respect for culture and diversity.

Desirable skills/experience includes:

  • critical analysis;
  • listening skills;
  • decisiveness;
  • experience in matters related to mental health; and
  • ability to function effectively in both official languages.

The composition of the Board’s gender and linguistic representation, as well as the cultural and geographic diversity of the province is a consideration for appointment.

Conflicts of interest

Conflicts of interest arise when there is conflict between the private interests and the official responsibilities of an individual in a position of trust. In other words, situations where a board member may derive personal benefits for themselves, friends, or families from actions or decisions made through their board involvement. Conflicts of interest can be real or perceived.

For example, board members should not:

  • directly or indirectly benefit from a transaction where they can influence decisions made by the Board;
  • use their position to solicit clients for business purposes;
  • accept fees, gifts, gratuities or other benefits which could reasonably be considered to influence their/board decisions; and/or
  • make use of any privileged information to their personal gain or the gain of others.

To ensure Agencies, Boards and Commissions (ABCs) are governed in the public interest, potential appointees are asked to disclose any obligation, commitment, relationship or interest that could conflict or may be perceived to conflict with their duties to or interests of the agency, board or commission to which they are seeking appointment.

Conditions / Compensation:

Hearings must be held within the time periods prescribed by the Criminal Code. Hearings are most commonly held at provincial court facilities and at the Restigouche Hospital Centre located in Campbellton. Attendance at Board meetings may be required.

Members who are psychiatrists are remunerated at a rate of $141.71 per hour; those serving as alternate chairperson receive $110 per hour; and the remaining members receive $60 per hour.

Rates of remuneration apply to the time spent coordinating and scheduling hearings, responding to general inquiries, order preparation, reviewing transcripts, preparing for and attending hearings, and other related duties as well as travel time.

All members are remunerated for travel expenses in accordance with the Government of New Brunswick Travel Directive AD-2801.
