Assessment and Planning Appeal Tribunal

Overview:

The Assessment and Planning Appeal Tribunal is established and obtains its mandate and authority under the Local Governance Commission Act. The Tribunal is an independent decision-making body given the responsibility of hearing appeals, analyzing the information presented and providing rulings on:

1. Property tax assessments (the market value assigned to individual properties);
2. Land use and planning decisions (decisions made concerning land development); and
3. Heritage conservation decisions (municipal heritage property conservation rulings made by a heritage board or heritage officer).

The Assessment and Planning Appeal Tribunal typically consists of:

• a Chair;
• a maximum of three Vice-Chairs; and
• two members, and one or two alternate members, from each of the five regions across the Province.

Members of the Assessment and Planning Appeal Tribunal are assembled to form panels in various regions of the Province to conduct appeal hearings. An appeal hearing panel consists of a Chair, and one or two members selected by the Chair from the region in which the appeal originates. Where a Tribunal member cannot act as a member, an alternate member or a member from another region, as designated by the Chair, may act in their place.

Hearings are scheduled by the Chair and take place as and where required. During a hearing, it is the panel’s responsibility to consider all evidence provided. The Chair, along with panel members takes into consideration the facts presented at the hearing and provide a written decision.

The Tribunal does not act on behalf of Government. It is linked to the Department of Environment and Local Government for administration purposes only. The Minister does not have decision-making powers in relation to appeals made to the Tribunal.

Current positions to be filled:

The Department of Environment and Local Government is now accepting expressions of interest from qualified candidates who would like to be considered for an appointment to the Assessment and Planning Appeal Tribunal as a member or alternate member.

Expressions of interest are invited to fill these positions but may also be used to fill future vacancies.

Qualifications / Commitment:

• Members and alternate members must reside in the region to which they are appointed.
• Members and alternate members must not be employed within the Civil Service of the Province.
• Appeal hearings are conducted on weekdays during business hours; members/alternate members must be able to attend hearings at these times.
• The Chair may, if he or she considers it necessary, designate a member or an alternate member to sit on a panel hearing an appeal in another region. In this instance, travel to another region would be necessary. 

Essential Qualifications/ Asset Qualifications:

The composition of the Tribunal’s gender and linguistic representation, as well as the cultural and geographic diversity of the province is a consideration for appointment.  

Conditions / Compensation :

Members and alternate members are entitled to remuneration of $80 for each half day and $160 for each full day of attended hearings and are entitled to be reimbursed for travel expenses incurred while acting on behalf of the Tribunal in accordance with the GNB Travel Policy (AD-2801).
